Terms of Sales
Their purpose is to define the contractual rights and obligations between the artist Nathalie BASTOS under the pseudonym Natalina, in particular via the website: hhtp: //www.natalina-art.com and his client, the sponsor of the service (natural person or moral).
Any client or sponsor of Nathalie BASTOS acknowledges having read this document before having signed or accepted the estimate, and having the capacity to contract. The order will be taken into account only after acceptance of the general conditions of sale of Nathalie BASTOS by the customer. Any signature of an estimate or written acceptance by mail, email or text message constitutes unreserved acceptance of these general conditions of sale. Any national of the European community and of countries respecting Directive 95/46 / EC cannot assert his linguistic ignorance as a cause for cancellation of the contract.
Article 1: The order
The order must be made in writing by mail, email or sms as well as sending the models and photos to be reproduced. The photos or models are subject to acceptance by Nathalie BASTOS who has the right to request other photos or models if the quality (pixels, framing, brightness, annoying accessories etc.) of the latter are not suitable. The estimate is valid for 2 months from its delivery to the customer or from its sending by electronic means or sms. Nathalie BASTOS reserves the right to refuse an order or to postpone it if all these conditions are not met. The missions are limited to those specified on the estimate or the contract. Any modification or supplement to the service will be subject to a new quote and a corresponding billing. The order becomes final after acceptance of the quote or prices by the customer and the payment of the deposit of 30% to Nathalie BASTOS. This deposit will be paid using the following means of payment: PAYPAL, transfer or check.
Even in the absence of a written order from the customer, the acceptance or delivery of artistic services constitutes acceptance of the general conditions of sale. Confirmation is made by sending an order summary email, indicating the indicative timeframe for the execution of the order.
Article 2: Services

Nathalie BASTOS offers artistic creation services for the production of portraits or decorative paintings of various styles relating to the plastic arts.
Nathalie BASTOS is not intended to carry out plans intended for the realization of building permits and is not assimilated to a works company.
Nathalie BASTOS undertakes to do everything possible to bring satisfaction to its client, in accordance with the established estimate, by informing him of the progress of his achievements. Once the service has been completed and delivered, the latter will no longer be able to raise any subjective arguments (of taste) to justify the restarting of the service or the refusal of payment for the services for which he is committed. However, adjustments can be made at the customer's request and at the discretion of Nathalie BASTOS during the performance of the service and before delivery. The service ends with the delivery of the works stipulated by delivery or by hand delivery and will be invoiced.
Article 3: Delivery times
The deadlines are defined following an oral and written discussion with the client and are specified in the estimate. Any commitment relating to these deadlines is released in the event that the payment conditions are not observed by the customer, delays due to the customer in sending the necessary elements such as models or photos and / or the delivery address or to additional requests (eg supervision) or in the event of force majeure.
Depending on the workload and the number of services ordered “on condition that the customer has responded” to the exchanges sent by Nathalie BASTOS for validation. The time available to the customer to respond to these emails is 3 days. If these deadlines are exceeded, Nathalie BASTOS reserves the right to extend the delivery time of the service accordingly and this without the customer being able to request any compensation for the delay that has been taken.
Once the order has been validated and confirmed the lead times and delivery in France are approximately 10 to 15 days for a dry pastel drawing in black and white or in color.
In the case of a portrait made in oil painting, the time is approximately 1 month taking into account the realization, drying and / hardening of the pictorial material as well as the packaging and shipping to France. .
The extended delivery times due to the Colissimo postal network or the transporter such as Chronopost, UPS, DHL, are in no way to be attributed to the responsibility of Nathalie BASTOS.
Article 4: Prices
The prices are in Euros and are not subject to a VAT rate in accordance with Article N ° 293B of the CGI. They are subject to change at any time. However Nathalie BASTOS undertakes to invoice the services ordered at the rates indicated when signing the quote or validating the order after written exchanges.
The framing service is offered by Nathalie BASTOS for certain portraits in drawing or painting if the customer requests it. The price will be defined and added to the quote or in writing in the exchanges.
The costs of material, execution as well as packaging and shipping by Colissimo in France are included in the price as indicated on the site www.natalina-art.com under prices.
Additional shipping costs may be added in the event of urgent shipment or abroad depending on the rates and weight of the package set by Chronopost, UPS or DHL. The customer will be aware of these prices in writing and must validate them in writing in return.
Article 5: Terms of payment
Payment for services is made according to these terms (unless otherwise specified in the estimate): 30% when ordering and 70% upon receipt of the package and up to 10 days after delivery.
Payment for online purchases or services can be made by PAYPAL at the address nathalie_bastos@yahoo.fr or by bank transfer, the RIB is indicated on the quote and on the invoice, otherwise it will be communicated to the customer by email. Payment by check is payable to Nathalie BASTOS, to be sent to 3, rue Jacques-Ange Gabriel 95140 Garges-Lès-Gonesse. Payment of the 70% will only be cashed after effective delivery of the service by Colissimo.
No purely subjective argument advanced by the customer can give rise to the reimbursement or non-payment of the service. Any significant modification requested by the customer will result in the invoicing of a new study. Only small changes will be taken into account. The maximum payment terms are 10 days after delivery.
Article 6: Late payments
For any payment after the agreed period of 10 days after delivery, a written reminder will be sent by email and / or SMS, a reminder by registered mail will then be sent. A late payment penalty will be applied, the rate of late payment penalties is equal to 12% / year, in application of article L-441-6 of the Commercial Code. Nathalie BASTOS reserves the right to involve a collection company, for example (France contentieux or Solvencia) to claim any amount due.
Article 7: The right of withdrawal
From the validation of the order by signing the quote for which the customer will have paid a deposit of 30% and in accordance with the legislation in force the customer has a period of 14 days to assert his right of withdrawal in writing to by Nathalie BASTOS. If this period expires on a Saturday, Sunday or a public holiday, it is extended until the first following working day .
The deposit paid will be returned to the customer by Nathalie BASTOS within 14 days after having been informed in writing (sms, email or mail). This present provision only applies to individuals.
Article 8: Cancellation, postponement, modification
Apart from the right of withdrawal within 14 days, any request for cancellation, postponement or modification of an order is subject to the agreement of Nathalie BASTOS. In the event of cancellation of the order, the amount paid corresponding to the 30% deposit cannot be refunded.
Article 9: Liability
In the event of late delivery or non-performance of delivery or damaged package or other disappointments due to the transport provider, or the postal network, Nathalie BASTOS cannot be held responsible. Nathalie BASTOS does not incur any responsibility in the event of non-performance or delay in service with the customer resulting from force majeure or from facts beyond her control such as: medical reason, bodily injury, internet network failure or telephone or any climatic or accidental event such as water damage, fire, burglary etc…. The interruption of the service could not give rise to the right to damages for the customer.
Article 10: Travel
In the event of delivery carried by Nathalie BASTOS, a mileage package for delivery will be added and calculated from Garges-lès-Gonesse to the customer's home according to the current rate, i.e. 0.56 € / km traveled, at this is in addition to the toll charges. This compensation is added beyond a radius of 15 km around Garges-lès-Gonesse.
Article 11: Confidentiality
The client authorizes Nathalie BASTOS to use sketches, photos, drawings, paintings and all images to illustrate its site, its commercial and advertising documents, social networks (Facebook, Instagram, Pinterest, Google Ads or other website). The customer can assert his refusal to distribute these images, photos, drawings or paintings in writing to Nathalie BASTOS by sms, email or post within 15 days after validation of the order, any request after this period will be considered as void.
Article 12: Protection of privacy
Nathalie BASTOS undertakes to keep confidential the personal information communicated by her client or any service sponsor. In accordance with Law n ° 78-17 of January 6, 1978 relating to information technology, files and freedoms. The personal information of the client or service sponsor, collected by Nathalie BASTOS is recorded in a computerized file by Nathalie BASTOS for communication purposes, monitoring the proper functioning of the service (s) as well as for e- mailing or newsletter sending.
The data collected will be communicated to the following recipients only: Collection company in the event of non-payment (eg France litigation, Solvencia), La Poste for sending parcels in the Colissimo network, and any transport company for sending parcels (UPS, Chronopost, DHL…).
The data are kept for 3 years by Nathalie BASTOS.

Article 13: Website

Consequently and in accordance with the French Intellectual Property Code, only use for consultation use is authorized. The services provided to the customer are governed by the code of intellectual property, they therefore remain the property of Nathalie BASTOS. The customer is prohibited from reproducing, copying, selling, reselling or exploiting for any commercial purpose whatsoever, all or part of the service or any right of access to the service. The customer refrains from launching any service on their own behalf or on behalf of another brand or a product that could directly or indirectly compete with Nathalie BASTOS 'activity.
Article 15: Applicable law and competent court
Nathalie BASTOS is a company incorporated under French law. The applicable law with the customer is French law. In the event of a dispute, the parties will favor an amicable solution. If no agreement is reached, the competent Commercial Court will be that of the headquarters of the company Nathalie BASTOS.
